Where the obligation actually sits

Commercial air-quality exposure runs through several instruments at once. This is the short version of what applies to a portfolio owner in Ontario and Quebec.

Ontario: the general duty clause under the OHSA

Ontario’s Occupational Health and Safety Act section 25(2)(h) requires an employer to take every precaution reasonable in the circumstances for the protection of a worker, with parallel duties on constructors under section 23 and supervisors under section 27. The province’s own guidance on mould in workplace buildings confirms this covers mould, states that sustained or extensive visible mould growth is not acceptable, and directs employers to seek professional assistance where contamination is extensive. Two parties are exposed in a leased building: you, as employer of your own building staff, and your tenant, as employer of theirs.

Quebec: RBQ licensing as a procurement filter

Under Quebec’s Building Act, construction work must be carried out by a contractor holding a valid RBQ licence, and remediation involving construction or structural work falls within that scope. Licences are publicly verifiable in the RBQ repertory, which is why most Quebec procurement processes check the number before a vendor is approved. Mold Busters holds RBQ licence 5726-4947-01. Quebec workplaces are separately governed by the Regulation respecting occupational health and safety, which addresses air quality at Division V section 39 and ventilation at Division XI sections 101 to 114.

Certification programs: BOMA BEST and LEED

Buildings pursuing BOMA BEST certification are assessed against an indoor air quality monitoring plan, with published targets including carbon dioxide not exceeding 700 ppm above ambient and carbon monoxide below 9 ppm. LEED and WELL carry comparable indoor environmental quality requirements. Where a portfolio is already inside a certification cycle, scheduled IAQ testing is work you are committed to regardless, which makes it the natural place to start a vendor relationship.

Buildings with federal tenants

Federally regulated workplaces fall under the Canada Labour Code and the Canada Occupational Health and Safety Regulations, which address ventilation and HVAC at Division III sections 2.20 to 2.27, and federal office buildings are additionally built and maintained to PWGSC mechanical standards. In practice this means a federal tenant escalates an air-quality concern through a documented process with its own timelines. Portfolios with federal tenants tend to want that documentation ready in advance rather than assembled under pressure.

Insurance protocols

Commercial property policies commonly require that remediation be performed by a licensed contractor, that post-remediation clearance testing be completed, and that a documentation package accompany any claim. Our standard project file is built to satisfy those three conditions as a matter of course, so the claim file is complete before anyone asks for it.

We warrant against mold recurrence inside the documented scope-of-work area for 12 months from the clearance date, conditional on the underlying moisture source having been corrected and the building envelope being maintained in reasonable condition. The conditional language exists because recurrence is almost always a water-source problem rather than a remediation problem, and we cannot warrant against a new leak. Where the moisture source sits outside our scope, such as a roof or envelope defect handled by another trade, we identify it in the report so it can be assigned.

Portfolio accounts are invoiced through a single point of contact, with purchase-order references and cost-centre coding applied per building where your accounts payable process requires it. Larger remediation projects can be structured as progress billing across deposit, milestone, and close-out stages rather than a single invoice on completion.
